Henderson Financial Group LLC dba HarborPoint Wealth Partners (HPWP) is committed to safeguarding and maintaining the confidentiality, integrity and security of the personal information that is entrusted to us. We do collect nonpublic personal information to provide you with accurate and pertinent financial and tax advice. We hold all nonpublic personal information you provide to us in the strictest confidence and do not sell your information to anyone. 

 

The categories of nonpublic information that we collect from you are detailed below. We use this information to help you meet your personal financial goals. Types of PII we collect include:  

  • Identifying Information: such as name, address, phone number, email address, social security number, and date of birth. 

  • Financial Information: such as assets & liabilities, account balances, net worth, and income & expenses.  

  • Transactional Information: such as investment activity and account history. HPWP 

  • Information from Third Parties: such as account statements, risk profiles, tax returns, insurance policies, estate planning documents, and other documents related to your financial and/or planning situations.  

 

We may disclose client identifiers, financial information, information obtained from third parties, and transactional or account data, as permitted by law, to the following categories of unaffiliated third parties:  

  • Custodians, Broker Dealers, and other Financial Institutions;  

  • Sub-advisors engaged to assist in managing client portfolios;  

  • Service Providers, including technology vendors, administrative support providers, and compliance consultants;  

  • Regulators or other Government Authorities;  

  • Attorneys, Accountants, Auditors, and Mortgage Lenders with whom you have established a relationship;  

  • Successors in connection with the sale or merger of Henderson Financial Group LLC; and  

  • Other third parties as permitted by law or with client written consent.  

 

Unless disclosed based on your request and consent, these disclosures are made via allowable exceptions so that we can provide services to you. Because these disclosures are made pursuant to exceptions under applicable law, opt-out rights do not apply to such disclosures. In the event disclosure would fall outside of these exceptions, an opt-out will be provided.  HPWP does not have any affiliates; therefore, it does not share nonpublic personal information with affiliated companies. We do not engage in joint marketing arrangements with nonaffiliated financial institutions or provide your personal information to solicitors.  

 

We maintain a secure office to ensure that your information is not placed at unreasonable risk. We employ a firewall barrier, secure data encryption techniques and authentication procedures in our digital environment. We require strict confidentiality in our agreements with unaffiliated third parties that require access to your personal information.  

 

Personally identifiable information about you will be maintained while you are a client and for the required period thereafter that records are required to be maintained by federal and state securities laws. After that time, information may be destroyed.  

 
This Privacy Notice will be provided at the time of engagement and annually thereafter as required by law. It applies to prospective, current, and former clients.

HarborPoint Wealth Partners LLC (“HarborPoint,” “we,” “us,” or “our”) respects your privacy and is committed to protecting the personal information entrusted to us. This Privacy Policy explains our privacy practices relating to our website and our HarborPoint-branded mobile application and client portal.

Our mobile application and client portal are powered by technology provided by Orion Advisor Technology and its affiliated companies (“Orion”). Orion provides technology and data-processing services that allow HarborPoint clients to securely access financial information and other features through HarborPoint’s branded digital experience. 

This Privacy Policy supplements any other privacy notices HarborPoint provides to clients pursuant to applicable federal or state financial privacy laws. 

 

Information We Collect 

In connection with our website, mobile application, client portal, and advisory services, HarborPoint and service providers acting on our behalf may collect or process information including: 

  • Name, email address, telephone number, and other contact information; 

  • Account and authentication information; 

  • Financial account and investment information; 

  • Portfolio holdings, balances, transactions, and performance information;

The HarborPoint mobile application and client portal utilize technology and services provided by Orion Advisor Technology and its affiliated companies. 

Through these services, clients may be able to access portfolio information, financial planning information, account information, documents, and other financial information and functionality made available by HarborPoint through the Orion platform. 

Although the application is branded for HarborPoint, certain technology infrastructure, hosting, security, authentication, data processing, and related functionality may be provided by Orion.

Orion’s collection, processing, use, and protection of personal information in connection with its technology services are also subject to Orion’s applicable privacy policies and contractual obligations.

How We Use Information 

HarborPoint may use personal information to: 

  • Provide investment advisory, financial planning, and related services; 

  • Provide access to the HarborPoint mobile application and client portal; 

  • Display account, portfolio, financial planning, and other client information; 

  • Authenticate users and maintain account security; 

  • Communicate with clients; 

  • Process client requests; 

  • Maintain and improve our services and client experience; 

  • Protect against unauthorized access, fraud, or cybersecurity threats; 

  • Maintain required business and regulatory records; and

How Information Is Shared 

HarborPoint does not sell your personal information. 

We may disclose or make information available to service providers that assist us in providing investment advisory and related services, including Orion, custodians, financial institutions, information technology providers, financial planning providers, communications providers, and other service providers.

These providers may process information as necessary to perform services on our behalf and are subject to applicable contractual, privacy, security, and legal requirements. 

We may also disclose information when required by law, regulation, regulatory examination, court order, governmental request, or other legal process, or when reasonably necessary to protect HarborPoint, our clients, or others from fraud, cybersecurity threats, or unlawful activity.

HarborPoint maintains administrative, technical, and physical safeguards designed to protect personal information.

The technology supporting our mobile application and client portal also incorporates security measures maintained by Orion. No method of electronic transmission or storage can be guaranteed to be completely secure.

Clients are responsible for protecting their login credentials and should notify HarborPoint promptly if they believe their account or credentials have been compromised. 

 

Data Retention 

HarborPoint retains personal information for as long as reasonably necessary to provide our services and satisfy applicable legal, regulatory, contractual, and recordkeeping requirements.

As a registered investment adviser, HarborPoint is subject to regulatory recordkeeping requirements that may require certain information to be retained even after a client relationship or mobile application account has been terminated.

Orion and other service providers may also retain information as necessary to provide services to HarborPoint and satisfy their applicable legal, contractual, security, and regulatory obligations.

Access, Correction, and Deletion Requests 

You may contact HarborPoint regarding personal information associated with your relationship with us, including requests to access, correct, or delete information where applicable. You may also request that access to the HarborPoint mobile application or client portal be terminated.

Certain information cannot be immediately deleted when HarborPoint or its service providers are required to retain it pursuant to securities laws, regulatory recordkeeping requirements, legal obligations, security requirements, contractual obligations, or other legitimate business purposes.

Where a deletion request can legally be honored, HarborPoint will take reasonable steps to address the request and, when appropriate, coordinate with relevant service providers.
